Terms of Use

These Terms apply to this website and to the game Constant Battle (together, "the Service"), run under the name Freegames ("we", "us"). By downloading the game, creating an account or using the website you accept these Terms. If you do not accept them, do not use the Service.

1. An independent, non-commercial project

The Service is a hobby project run by volunteers. We do not charge for the game or for access to it, and we do not run it to make a profit. Nothing in the game has to be bought with real money.

2. No connection to Renova Games

Constant Battle is inspired by Desafio Mortal, an audiogame made by Renova Games that has been discontinued. We credit it as the origin of the idea.

The game's features, code and sound system were written independently by us, and no source code from Renova Games is used.

The Service is not affiliated with, authorized by, endorsed by or sponsored by Renova Games. Nobody who runs, moderates or plays the Service speaks for Renova Games or represents it. We do not claim to be its successor, its licensee or its official continuation, and we do not offer any support on its behalf.

Desafio Mortal, Renova Games and any related names, logos, trademarks and materials belong to their respective owners. We use those names only to describe where the idea comes from. Nothing in these Terms or on this website gives you any right to them.

3. Third-party rights

  • Do not upload, post, share or distribute any material that belongs to Renova Games or to anyone else, unless you have the right to do so.
  • Do not pretend to be Renova Games, or to be connected to it, in the game, in chat, on this website or anywhere else when talking about the Service.
  • Do not use the Service to sell, trade or promote anything that belongs to Renova Games or another rights holder.
  • We grant you only the rights that we ourselves hold. We do not license, and cannot license, rights that belong to other people.

4. Concerns from rights holders

If you are a rights holder and you believe something in the Service infringes your rights, write to us using the contact details on the home page and say what concerns you. We will review it promptly and cooperate, including by changing or removing the material in question, or by changing or ending the part of the Service that is affected.

5. Who may play

You must be old enough to agree to an online service under the law where you live. If you are younger, you need the permission of a parent or guardian. You may only create accounts with e-mail addresses that you control.

6. Your account

  • Give a real e-mail address. We use it to send login codes, support answers and recovery messages.
  • Keep your password secret. You are responsible for what happens on your account.
  • If you mark a computer as trusted, anyone who uses that computer can log in without a code.
  • You may rename a character once a day. We may refuse or undo a name that is offensive, misleading or that imitates someone else, including staff.
  • We may delete accounts that have been unused for a long time.

7. Fair play and conduct

Do not:

  • use cheats, exploits, bots or modified programs to gain an unfair advantage, bypass a ban or harm the server;
  • attack, probe or overload our servers, or try to access other people's accounts or data;
  • harass, threaten or discriminate against anyone, or post hateful, sexual, illegal or misleading content in chat, names or voice messages;
  • impersonate staff or other players;
  • advertise, spam, or sell or trade game items, characters or currency for real money;
  • share a modified client or server that changes how the game works for other people.

8. Moderation

Staff and Instructors may warn, mute, jail, rename, ban or remove players, delete items or reset characters when these Terms or the game rules are broken, or to keep the game safe. A ban may apply to a name, an IP address or a computer. We state the reason and the duration where we can. You can appeal by opening a ticket or writing to us. Decisions are made at our discretion.

9. What you post

You are responsible for what you write or say in chat, in voice messages, in tickets and in character names. By posting it in the game you allow us to store it and to show or play it to the players it is meant for, and to review it for moderation. Do not post anything you do not have the right to share.

10. Game items and currency

Coins, items, levels, houses and everything else in the game exist only inside the game. They have no real-world value, cannot be exchanged for money, and are not your property. We may change, reset or remove them at any time, for example for balance, bug fixes, security or a restart.

11. Downloads and software

The game is small independent software and is not digitally signed, so your system may show a warning. We try to keep downloads safe, but you install and run the game at your own risk. Keep your own backups, and use up-to-date security software.

12. Availability and changes

The Service is provided free of charge, "as is" and "as available", and without any promise of availability, accuracy, fitness for a particular purpose, or that it will be free of errors. We may change, pause, move or shut down the Service, or any part of it, at any time and without notice, including if a rights holder or authority asks us to. Data can be lost.

13. Limits of our responsibility

To the extent the law allows, we are not liable for indirect or consequential loss, loss of data, loss of game progress, or for anything that happens because of your use of the Service. This does not limit any liability that cannot be limited under the law that applies to you, and it does not affect your legal rights as a consumer.

14. Ending your use

You may stop using the Service at any time and may ask us to delete your account. We may suspend or end your access if you break these Terms.

15. Changes to these Terms

We may update these Terms. The date at the top shows the latest version. If you keep using the Service after a change, you accept the new version.
